1. Acceptance of Terms

By accessing or using RealtorClaws ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

RealtorClaws is a marketplace platform that connects buyers and sellers of AI-powered skills, personas, and automation tools designed for real estate professionals. The Service allows creators to list and sell digital products and buyers to purchase and download those products.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

  • Provide accurate, current, and complete information during registration
  • Update your information to keep it accurate and complete
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with others

4. Buyer Terms

4.1 Purchases

When you purchase a product on RealtorClaws, you are granted a non-exclusive, non-transferable license to use the product for your own personal or business purposes. You may not resell, redistribute, or share purchased products.

4.2 Downloads

After purchase, you will have access to download the product files. Downloaded products are provided "as is." While creators strive to ensure quality, we cannot guarantee that products will meet all your specific requirements.

4.3 Refund Policy

We offer a 30-day refund policy on all purchases. If you are not satisfied with your purchase, contact support within 30 days for a full refund. Refund requests after 30 days may be considered on a case-by-case basis.

5. Creator Terms

5.1 Eligibility

To become a creator, you must apply and be approved by RealtorClaws. We reserve the right to approve or reject applications at our discretion.

5.2 Membership

Creators are required to maintain an active membership subscription. If your membership lapses, your listings will be hidden from the marketplace. Existing buyers will retain access to their purchased products.

5.3 Content Requirements

As a creator, you agree that your products:

  • Are your original work or you have the rights to sell them
  • Do not infringe on any third-party intellectual property rights
  • Do not contain malicious code, viruses, or harmful content
  • Are accurately described in your listing
  • Comply with all applicable laws and regulations

5.4 Revenue Share

Creators receive 80-90% of each sale, depending on membership tier. The platform commission covers payment processing, hosting, and platform maintenance. Payouts are processed monthly via Stripe Connect.

6. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any intellectual property rights
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to the Service
  • Interfere with the proper functioning of the Service
  • Harass, abuse, or harm other users
  • Use automated systems to access the Service without permission
  • Circumvent any security measures

7. Intellectual Property

The RealtorClaws platform, including its design, features, and content (excluding user-generated content), is owned by RealtorClaws and protected by intellectual property laws. Creators retain ownership of their original products while granting buyers a license to use them.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALTORCLAWS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Indemnification

You agree to indemnify and hold harmless RealtorClaws, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
